As an ADVERTISER/CUSTOMER with LISTOPT PUBLICATIONS INC. and by placing an order from our website, YOU are acknowledging that you have read and agree to the terms set forth below.

ADVERTISER/CUSTOMER PURCHASER AGREEMENT: By purchasing opt-in email addresses from LISTOPT PUBLICATIONS INC. or one of our reselling partners, you are confirming that you have read and agree to the following terms of service:

In no way can LISTOPT PUBLICATIONS INC. be held liable for the success or outcome of your subscriber/lead purchase.

I as the ADVERTISER/CUSTOMER understand that LISTOPT PUBLICATIONS INC. will advertise my newsletter(s) and or offer(s) in the ListOpt.com Directory and on their affiliate website's to increase my newsletter's exposure. I further understand that LISTOPT PUBLICATIONS INC. may at it's sole discretion, choose to offer subscribers added incentives for subscribing to advertised newsletters including but not limited to sweepstakes and free offers.

I as the ADVERTISER/CUSTOMER understand that LISTOPT PUBLICATIONS INC. will send my subscribers to my autoresponder address should I request them to. I understand that this feature is only available should I chose to purchase double opt-in subscribers. Due to circumstances that are outside the control of LISTOPT PUBLICATIONS INC., I further understand and herby accept that LISTOPT PUBLICATIONS INC. will not be held liable in the event that my purchased subscribers do not get automatically or manually imported to my autoresponder.

ADVERTISER/CUSTOMER RESPONSIBILITIES: I as the ADVERTISER/CUSTOMER agree not to send unsolicited commercial email (SPAM) of any kind to any person who has specifically requested a subscription to my newsletter using the ListOpt.com site. I as the ADVERTISER/CUSTOMER agree that this product will be used solely within the country where I, the ADVERTISER/CUSTOMER is resident.

LIMITATION OF LIABILITY: I as the ADVERTISER/CUSTOMER hereby indemnifies and holds harmless LISTOPT PUBLICATIONS INC. and any entity or individual associated with this Agreement from any and all liabilities, costs and expenses, including, without limitation, reasonable attorney's fees, that may arise from advertising via ListOpt.com or breach of the terms of this Agreement. The ADVERTISER/CUSTOMER will be solely responsible for defending any claim, payment of damages or losses resulting from the foregoing to both a third party and ListOpt.com

PAYMENT: The ADVERTISER/CUSTOMER agrees to pay LISTOPT PUBLICATIONS INC. and or it's authorized resellers all applicable charges to its account in United States currency, in accordance with the terms of the payment plan selected, including, if any, all applicable taxes, in accordance with billing terms in effect at the time the fee becomes payable. All payments are non refundable.

Payments can be made via our authorized reseller, 2Checkout.com, Inc. (2CO) or PayPal.com. All charges will appear on my billing statement as being from LISTOPT PUBLICATIONS INC., Paypal.com, or 2Checkout.com, Inc. (2CO)

TERMINATION: If I the ADVERTISER/CUSTOMER wish to suspend or cancel my List Builder account I must do so by written notice via our help desk at http://listopt.com/helpdesk. Notice of cancellation by email is not acceptable. If I the ADVERTISER/CUSTOMER decide to terminate my own account, and I the ADVERTISER/CUSTOMER provide written notice to ListOpt Publications Inc., my account will be deemed terminated once my List Builder account has exhausted all funds and reaches a $0.00 balance. I understand that there are no refunds on payments made prior to suspension or termination.

The ADVERTISER/CUSTOMER recurring billing will be terminated effective immediately and no further charges will be requested. The ADVERTISER/CUSTOMER List Builder account will be deemed either suspended or terminated seven (7) days after ListOpt Publications Inc. receives such notice provided all outstanding balances have been paid in full.

I, the ADVERTISER/CUSTOMER, understand that I, the ADVERTISER/CUSTOMER, am solely responsible for the cancellation of any payment plans that I, the ADVERTISER, have in place with Paypal.com, or 2Checkout.com, Inc. (2CO).

I, the ADVERTISER/CUSTOMER, understand that this is a legally binding agreement between I, the ADVERTISER/CUSTOMER, and LISTOPT PUBLICATIONS INC.
